Starbucks Faces New Lawsuit Over Scalding Hot Drink Spill

NORWALK – Another Starbucks customer sued the coffee store chain On Wednesday, he claimed that after receiving a hot beverage from a drive-thru worker, the lack of a secure lid caused the drink to spill onto his lap, resulting in injuries.

Ernesto Vladimir Sanchez Avendano's lawsuit filed at the Alhambra Superior Court is seeking undisclosed compensatory and special damages due to alleged negligence.

The lawsuit claims that on April 3, 2023, Avendano visited the Starbucks location at Sherman Way in North Hollywood. After ordering a hot beverage from the drive-thru, he moved to the pickup window. Upon receiving his drink, which had an improperly sealed lid provided by a staff member, hot liquid poured over his lap. This incident resulted in severe injuries including "significant burns, scarring, and lasting nerve damage" to his genital area and buttocks, as stated in the legal filing.

The lawsuit asserts that 'there cannot be a reasonable assumption of an insecure lid on a cup of hot liquid based on the plaintiff's behavior,'.

Not long ago, a Los Angeles Superior Court jury ruled that Starbucks must pay $50 million to Postmates delivery worker Michael Garcia. This compensation follows injuries he sustained from third-degree burns when a scalding beverage accidentally spilled on him in February 2020 because the lid wasn’t properly attached to his cup after receiving his order at a South Los Angeles drive-thru window.

On last Thursday, Sabrina Michelle Hermes initiated a comparable lawsuit alleging negligence concerning injuries she claims to have sustained at a Starbucks drive-thru location in Norwalk back in 2023.

A spokesperson for Starbucks Corporation mentioned on Wednesday that they could provide a statement later regarding Avendano’s lawsuit. Previously on Wednesday, the firm had addressed Hermes’ legal action, asserting that the allegations made by the plaintiff lack substance.

“A Starbucks spokesperson stated in an announcement made Wednesday, ‘Our commitment to maintaining the utmost safety protocols within our outlets, particularly concerning the management of hot beverages, remains unwavering.’ They added, ‘We acknowledge Mrs. Hermes' assertions but strongly feel they lack substance. We are eager to present our defense during the legal proceedings.’”

Hermes' lawsuit filed in the Norwalk Superior Court alleges negligence and requests compensation for various damages, such as unreimbursed past and anticipated future medical expenses and loss of income.

The lawsuit claims that on April 2, 2023, Hermes visited a Starbucks location at the address 11000 block of Firestone Boulevard. She ordered hot beverages through the drive-thru service. However, due to inadequate securing of one of the cups, the contents spilled over several areas of her body such as her legs, hip, thighs, knee, and feet, resulting in significant harm, according to the legal documents.

According to the lawsuit (CNS), Starbucks had a responsibility "to ensure they handled, prepared, and served hot drinks carefully to avoid spills that could injure their patrons like the plaintiff."
